Welcome to Anxiety Relief Clinic’s (referred to herein as “Anxiety Relief Clinic”, “we”, “us”, or “our”) Terms & Conditions (referred to herein as the “Terms”).
These Terms apply to all users of our website, https://anxietyreliefclinic.com/ (our “Website”), our mobile website, our social media accounts, our Services, or other platforms now or hereinafter created (our “Platform”). By using our Platform, you agree to be bound by these Terms.
If you do not agree to be bound by these Terms please do not use our Website or our Services. Your use of our Website, our Services, or our Platform constitutes acceptance of these Terms.

Our Website is designed to provide information on various topics related to mental health, psychiatry, and emotional wellness. Such information may include data, articles, services, programs, opinions, images and photographs, audio/video recordings, copy, illustrations, and teachings (collectively, “Website Content”).
Our Website Content is purely informational in nature and should not be relied upon by you or any third-party. Should you rely on any piece of information contained on our Website, you do so at your own risk.

Section 4 - Our Services & Technology Requirement

Anxiety Relief Clinic provides mental health and emotional wellness services, including consultations and telemedicine services.
In order to enjoy the benefits of our Services, you must meet certain technological requirements such as having access to the internet and a robust smartphone or computer. We provide telemedicine Services, meaning that you may elect not to come into any physical office and our Services will be provided to you across the telephone, e-mail, video conferencing platform, or other platform now in existence or hereinafter created. To the extent that you may access or use our Services through your mobile device, your wireless carrier’s rates and policies may apply.
When you provide us with your contact information and communicate to us via email, phone, or text, you explicitly consent to receive communications from us in connection with providing you the Services. By signing up for our Services, you acknowledge and agree that Anxiety Relief Clinic will send you emails or other forms of communication relating to your Services.
By consenting to the receipt of calls, texts, and emails, you acknowledge and agree that Anxiety Relief Clinic may be transmitting certain protected health information (“PHI”) to you. Anxiety Relief Clinic agrees to comply with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and all related and applicable laws during the provision of our Services. However, you acknowledge and agree that while Anxiety Relief Clinic has taken commercially reasonable steps to protect your PHI, no system is 100% secure.
We use a secure email portal for client communications to protect your PHI and the content of these communications. If you send any information, including PHI, outside of our secure portal, you do so at your own risk.

Section 5 - Services Disclaimer

Use of our Services may not be appropriate for emergencies. If you are having an emergency or think you are having an emergency, please call 911 or go to the nearest hospital, clinic, or other emergency center.
No doctor/patient relationship is created solely by your use of our Website and/or by scheduling and participating in our initial consultation. In order to become a client of Anxiety Relief Clinic, you are required to first attend our initial consultation and then if you and Anxiety Relief Clinic determine that our services may be of assistance then additional scheduling and steps will be provided for you.

Healthcare providers working with Anxiety Relief Clinic may operate as independent healthcare professionals and are responsible for their own professional conduct and licensing.
While the people we work with as healthcare providers endeavor to provide high quality services to each client, not every relationship is a good fit due to personality or other reasons. If you are unhappy with the person you are currently working with, please contact Anxiety Relief Clinic and we will attempt to help you find a provider that better suits your needs.
Finally, when you sign up for our Services, you are contracting with Anxiety Relief Clinic and not any individual healthcare provider. Due to this, we ask that you do not solicit healthcare providers associated with Anxiety Relief Clinic to provide services outside of Anxiety Relief Clinic.

Section 6 - Use of Services, Registration, & Member Account.

To become a client of Anxiety Relief Clinic, you are required to register and complete certain paperwork which will grant you access to the Services. When you register to become a client of Anxiety Relief Clinic, you will be providing us with certain information necessary for providing our services. When you provide us information of any kind, you represent and warrant that all such information is true and correct to the best of your knowledge and that if you discover any inaccuracies you agree to correct them within a reasonable timeframe.
Our Services are only available to those individuals who are at least eighteen (18) years of age.
Our Services may change depending on current regulations and requirements. If changes occur, Anxiety Relief Clinic will update you within a reasonable timeframe.

In order to use our Services, you will be required to register with our secure patient portal. It is your responsibility to maintain the confidentiality and security of your account and password. You are responsible for any activities that occur under your account. Anxiety Relief Clinic is not responsible for actions or transactions made using your account by you or any third-party.

Section 7 - Billing and Payment.

Our current pricing rates can be found on our Website and are incorporated by reference herein. If there is a change to the cost of your Services, this information will be updated on our Website.
When you become a client of Anxiety Relief Clinic, you may be required to provide a credit card for billing purposes. It is your responsibility to ensure that your payment method remains active while you are a client. Failure to maintain an active payment method does not terminate these Terms or alter your obligation to pay for Services rendered.
When you provide payment information, you represent and warrant that the information is accurate and that you are authorized to use the payment method provided.
Failure to pay for Services may result in past due amounts accruing interest and the possible transfer of the balance to a collection agency or legal representative for recovery.

Section 8 - Insurance.

Anxiety Relief Clinic accepts certain insurance plans for Services. Coverage availability varies by plan and individual policy. As a courtesy, we will attempt to verify your insurance benefits prior to your first appointment; however, this verification is not a guarantee of coverage or payment. It is your responsibility to confirm your coverage directly with your insurance provider.
Where insurance is billed, you remain responsible for any amounts not covered by your insurance, including copayments, coinsurance, deductibles, and any services deemed non-covered or out-of-network by your insurer.
Anxiety Relief Clinic is not an insurance provider and cannot guarantee coverage determinations made by your insurance company. Insurance coverage is subject to change, and any such changes are beyond our control.
If your insurance does not cover the Services, or if you elect not to use insurance, you are responsible for payment of all applicable fees at the rates listed on our Website.

Section 9 - Cancellation Policy.

Anxiety Relief Clinic and our healthcare providers understand that appointment changes or cancellations may occur. We try to be as accommodating as possible.
Unless otherwise agreed, all changes or cancellations must be made at least twenty four (48) hours before the scheduled appointment time. Otherwise you may be billed for the full cost of the appointment.
If you are running late for an appointment, please notify Anxiety Relief Clinic or your healthcare provider as soon as possible. If you are more than 15 minutes late without notifying us, the appointment may be considered a no show.
Refunds cannot be provided for missed appointments or no shows.

Section 10 - Limitation on Use.

You may not remove copyright or trademark notices from our Website or Services, reproduce or distribute our content without permission, reverse engineer our Website or Services, scrape data, attempt unauthorized access to our systems, or interfere with the operation of the Platform.

Section 11 - Accuracy of Information.

Anxiety Relief Clinic is not responsible if information made available on our Website is not accurate, complete, or current. We strive to keep all information updated but errors may occur.
We reserve the right to modify the contents of these Terms at any time. You agree that it is your responsibility to review these Terms periodically.

If you send us creative ideas, suggestions, proposals, plans, or other materials (“Submissions”), you agree that we may use them without restriction.
We are not obligated to maintain Submissions in confidence, compensate you for them, or respond to them.
“Submissions” specifically does not include your protected health information.

Section 13 - Our Intellectual Property.

The contents of our Website and Platform are protected by copyright laws. All content on the Website and Platform is owned by Anxiety Relief Clinic.
You may not reproduce, distribute, or use our intellectual property for commercial purposes without written consent.
We grant you a limited, revocable, non transferable, and non exclusive license to access and use our Website for personal purposes only.
Any unauthorized use automatically terminates this license.

TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR SERVICES IN THE THREE (3) MONTHS PRIOR TO THE CLAIM.
ANY LEGAL ACTION ARISING FROM THESE TERMS MUST BE COMMENCED WITHIN TWELVE (12) MONTHS OF THE DATE THE CLAIM ARISES.

Anxiety Relief Clinic reserves the right to modify these Terms at any time without notice.
By continuing to use the Website or Services you agree to any modifications made to these Terms.

Entire Agreement. These Terms constitute the entire agreement between you and Anxiety Relief Clinic regarding the Services.

Applicable Law/Dispute Resolution. This Agreement shall be governed by the laws of the State of California. Except for non payment of fees, disputes will be resolved through binding arbitration according to the rules of the American Arbitration Association.
Notices. All notices must be sent via email.
Force Majeure. If circumstances beyond the control of the parties such as natural disasters, pandemics, or government regulations prevent the Services from being performed, the Services may be paused or terminated.
Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in effect.
